Regulation 2.5 of MLC 2006 gives seafarers the right to be repatriated at no cost to themselves.
When does the right arise?
In general, the right to repatriation arises when:
- the employment agreement expires,
- the agreement is terminated by the shipowner,
- the seafarer is sick or injured and cannot continue to work,
- the ship is wrecked,
- the shipowner is unable to fulfil legal or contractual obligations, for example because of insolvency or sale of the ship.
How long?
The maximum duration of service periods on board following which a seafarer is entitled to repatriation shall be less than 12 months.
What to do
- Read the repatriation terms in your contract.
- If there is a problem, make a written request and keep a copy.
- If it is not resolved, contact the flag State, port State control or seafarers' unions and welfare organisations.
